**2008 Thundercats Calendar Pic Submission** Updated 9/8/07

Ok, here's the deal for submitting pics. Your camera needs to be able to take at least a 2xxx (by) 1xxx size pic. I'm thinking around a 5 megapixel minimum. Take the highest resolution pic rated for your camera. I can shrink the pics if needed. That is not a problem. What I can't do (well I can, but it looks bad) is increase the size of the pics. Bigger is better in this case.

I would like around 10 pics minimum. That gives me a little leeway  in composing the layouts.

You can send me pics via a plethora of ways. CD, DVD, FTP, email, and so forth. If your worried about clogging up my email account... don't. I have about 89% of free space still, which includes all of the pics sent to me via email from last year.

If you want to post your smaller websize pics in the this thread to show off, feel free.

2008 Thundercats Calendar Discussion

Yeah, I know it's kinda early, but I want to get some ideas going now so when CatJam rolls around I can be best prepared. Also, CatJam seems to be the best time to start the calendar off with all the cars and photographers and stuff. :D Just call it a hunch. There are couple things I won’t change, like the 1:1 Bird-Cat ratio and the name. But everything else is fair game and open for discussion.

There will be more graphics in the 08 Calendar, details of the car and possibly the owner. Considering the sales made this year (about 29 sold as of typing this) I think I could do three different sizes for those who don’t want to fork out nearly $30 shipped for a calendar. Which is understandable. Also if I can get at least 15 people to buy within a group the price will be considerably cheaper. I’m thinking under $20-shipped. But those details can be ironed out in the 330ish days left until 2008. :D

I am NOT looking for submittals at this time.  Just ideas and things you would like to see in the next calendar.

If you are seriously going to put specs in it this time I think it's fair to give the 2007's another crack at it. I'd especially like to see David and Eric's Cougars again. I DO think that no matter what, come submission time, it should be "all new" pictures of the car in it's current state.

I've got a suggestion...

Split the layout between the cars (half Cougar, half T-Bird). That will get you 24 cars on the calendar, plus you'll have the cover again for the rest of the cars (and maybe it won't be as crowded LOL). At the larger size you have PLENTY of room for pix and info for 2 cars. And every month you'll have one of each car, which should make each buyer at least half happy. :hick:

Plus, at 2 cars per page, a lower-resolution photo won't be nearly as grainy...although personally I didn't have an issue with this year's photos. For upsizing they all turned out fairly well.

Personally I don't want another spread on my convertible for next year. I would, however, like to request next December again... ;)

How about something like Claude mentioned before. A few layouts of those of us who have more than one car.

I like that last one. Layla and the matching Med Red Cougar looked good together, or my 83 and Layla. Fred, your 2 Cougars on 1 month would rock. 83-88TBirdguy's 4 Birds would be interesting too.

I like Eric's suggestion of both a Bird and Coug for each month.

Hopefully mine will be painted and ready to appear this time around :hick:

I dunno now. I'm sitting here staring at the very nice pic of David's Coug and I must say, I rather prefer it. I wish the 4 little pictures were bigger and it had some specs, but the 1 big shot really looks nice.

Actually, I nearly did that for the 2007 Calendar. And since I'm starting out early, :D it is pretty much going to be implemented. I didn't have nearly enough photos or time to carry it out before.

I also agree that all new photos should be used. I would say those not in last years... this years calendar should be given first crack, but I can't rule out not using some of the same cars from... this years calendar. lol. That is so confusing. xD

What about the info... what kind of info? The one thing I did learn is that not everybody has the same amount of info about their cars. Which is the big reason why it didn't make it to this years calendar. Trying to make a format where everything is consistent from page to page became unexpectedly challenging. In hindsight I could of just gone with the basics, but I panicked with the new year a coming and sped the whole thing.

Lots a good idears already. :D Keep em coming.

I think it would be great to have a construction calendar.

Similar to the current calender but instead of other pics of the cars, various stages of construction.

Just a thought.

If you split the page with 1 'Bird and 1 Cougar, i think it would be cool to do the same year on the same page. Ex. Jan. and Feb. could have '83s and March and April could have '84s. That way it would be a progression through the years. I think its a cool idea anyhow.

I agree that the info is a bit of a tough thing.
Not everyones car is modded and not everyone has raced their cars.

I think you could file each car into a category such as original, weekend racer, daily driver, overall modified and so on.
Then you could put info according to their category.

So if the car is...
original, list mileage, color, options etc
raced, list mods and ETs
daily driver, list mileage, color, options, average mileage per week or something of that sort, any modifications etc
overall modiefied, list what they started with and what it took to make it what it is.

Name of owner
Year/make/model/trim
"owned since" date
BASIC engine/trans (5.0/T5, 2.3T/T5 whatever)

ONE car per month, 6 Birds and 6 Cats, by popular vote.

Only exception is if same person owns 2 cars, that would be cool

Keep the 1 giant photo with a few smaller ones, it's gotten a LOT of compliments around the shop, just make the smaller ones *slightly* bigger.

I'd like to see it with a bird and a cougar on the same pages and if people have more than one car they must have them in the same pic and not taking up more than half of the page since they should leave room for others cars. alot of us want in, well I know I do and I'll do whatever it takes to get the car more presentable to be in the calendar :hick:

There's going to be a calender every year. Calenders featuring multiple cars not in the same picture are VERY ameteur looking. This year's calender has recieved a LOT of compliments, and I think we should stick with it.

I agree with some of the others, I think the best way to go is one car per month. I think it would look kind of sloppy and "cramped" to have one of each per month. If you get a lot of cars wanting in, maybe the best route to go would be one bird calendar and one cougar calendar? And for the specs, I think the main things would do it. Year, model, colour and engine. The name of the person who owns it would be kinda neat too.

And, if you use my car, can I call dibs on August?

I just thought of another idea for pic layout. What if you got everyone who's going to be in the calendar to take the same pics of their cars? Like, for the big main pic, have them all take it from the front but on an angle from either side and then had 4 smaller pics? Say, one of the front head on, one of the rear head on or angled, one of the engine and the last of the interior? Or maybe just the three smaller pics cuz not everyone has a really clean/nice interior...I think that would look really "smart" and "professional". Kinda like one person took all the pics for the whole calendar....

Yeah, I think the main pic should be a front angle pic, with straight pics as thumbnails.  And an engine shot as well.

As for me, I'd LOVE to get my Tbird in next year's calendar since I missed out on this year's.  I think she's clean enough now :) .

I think having a Bird and a Cougar on the same month will give the calendar a more beefy look....maybe a shot with the owner and some specs underneath... I do agree the modded cars should be separate from the stock daily drivers....
I would love to see my car in there again with some specs... I have sooo much done to it.... lol I love it...
I just redid the whole rear end suspension of the car and a TKO600 is going in very very soon........

Oh ... I need to start working on this. Time is flying by... :D

For this calendar I want to use an overall graphics style theme. For example I can give the calendar a grungy look, a sporty feel, an elegant look or a techy look just to give a few examples. I'll create a few example pages and we can vote on them.

The "feel" of the last one was spot-on.

It NEEDS to stay 1 car/month though.

Oooooooh yeah...me likes that idea big time. From a designer's point of view, that will help things signficantly and look very professsional. I don't think those should be the only views, but they should be the minimum requirements for submission. Antonio needs a good base set of photos for each car to mess around with, when composing the layouts. No good photos, no good layouts, simple as that. We need variety but also need standards.

Now that we know what works and what doesn't from the '07 calendar, and also now that we can expect the same large-size format as the '07 calendar, we really should set some kind of requirements for 2008. Something like...

- Minimum file dimensions (ex: min. 4.0 megapixel camera set at maxiumum resolution)
- Minimum amount of photos (which could be as BlondeThunder pointed out)
- All the display text (car info, specs)
- Owner's name and location
- Deadline date

This way, Antonio isn't trying to coerce people for submissions at the last minute. We have to make things as easy as possible for him because he's the composer doing all the grunt work. With standards set, everyone can be assured of an extremely high quality product. These calendars aren't inexpensive, by any means, so we need the highest quality possible for the money. What do you think, Antonio?

I still really like the 1 car/month setup from a visual point of view. But with 2 cars/month we maximize the total cars that can fit on the calendar. That was the only reason I ever mentioned it. Then again, it could look a bit crammed. I'm fine with it either way though. Just thankful that we have this opportunity. ;)

I think the only way visually the 2 cars per month can be pulled off nicely is if both cars were taken in the same photograph. My suggestion would be to do calendar photo-shoots perhaps at Cat Jam..

I agree, requirements make my job a whole lot easier and I can concentrate on producing the calendar (I actually did have some last year, but very few people followed them :D). I also agree that the 1 car a month looks really clean. After seeing the calendar at home and at work for the pass months I have to say I really like that format.  I'm inclined to believe that 2 cars with stats and whatnot would be very busy even on these huge calendars. The page would need to be in the portrait orientation to not be an eyesore IMO.

Now I know everyone doesn't have a nice camera, so I'm hoping someone at CatJam can help out with that. Any volunteers? Please contact me. I'm also thinking about getting some webspace and creating an FTP account for people to get their pics to me. Seems as though most peeps are afraid (or can't) email me their largest file size. I'm also going to create some sort of standard file (.doc, .pdf, .xls & etc...) for Owner Info and Stats. If there's one thing I learned from last year, it's "get f'n organized!!!".

And yeah, your right Eric, they aren't cheap. I could in theory take pre-orders for a bulk discount (think close to half-off). I'll try it and see how it goes. I think I need at least 15 orders. Which if this year is anything like last year that should be no problem.

I'm also thinking about doing some kind of contest to give away a free calendar. Nothing serious... maybe just a poll on who made the most progress this year or who's thundercat should be crushed or even something more official like "People's Choice". :)

And lastly I wouldn't mind farming out some of the workload. I know Claude was going to help last year, but I wasn't organized enough to send out the work. Whether or not that will change will depend solely on me. But I wouldn't mind having a couple names listed just in case.

Well I'm done yappin, I need to go to bed. I've got a double coming up.

Wow...Colorado...that's a haul. Fortunately it's straight down I-80 though. :)

http://www.catjam.net/

Past years' photos are there on the left; we tried to get pix of every vehicle. Average of around 30-35 cars per year. Hoping to top 40 this year. It doesn't sound like much, but we have around 13-15 different states, plus Canada, represented every year. Some people make VERY long trips. The tenacity of this group is just amazing.

I was so excited from CatJam I decided to get started on the calendar right away. These guys just happened to show up in nearly identical TCs, one by pure co-inky-. But more on that later. Here's the current WIP.

Alrighty, I need to get the ball rolling on this thing.

Geez, I cannot believe it is September already. =/

Start submitting!

Thanks.

Hey Bearmax, just an FYI the largest pic you sent me was 1280px by 960px. That's still too small for a monthly. If you have or can take higher-res pics that would be great. Thanks.

Alrighty, I need to get the ball rolling on this thing.

Geez, I cannot believe it is September already. =/

Start submitting!

Thanks.

how long will you be accepting pictures?

83-88TBirdguy's whole driveway

I am thinking that Thanksgiving Weekend is going to be the deadline for pic submission. I am also redesigning the layout. It should help compensate for the differences in the quality of everyone's equipment and uhm... photography skills. :D

And if you see me spamming up the threads it's because I'm trying to get the artistic juices flowing again.

The new layout... Ignore the excess grayness... those are the areas that may or may not show in print. I just haven't figured out how I want to show those areas.

Also keep in mind that most of the graphics are missing... the colors are not permanent.  I just through some colors in there.

Still not a fan. The giant squares of color are distracting and there are too many pics. One big one, the black&white on the side and 2 pics of the same side on the left or bottom. The colors are too dark as well.

I think it looks great!  I personally think that you should use the newer style, but making the Big picture BIGGER, and the smaller pictures a little bit smaller.  That way, there isn't quite so much empty, or filler space on the pages.

Otherwise, great start!!  I'm really liking it!

Bigger pics are nice, but if you bought a calendar from last year (BTW, thanks), you can totally tell which ones were not suitable for large print. I feel that this is a nice compromise. I will tweak the main size some more, but this is pretty much what it will look like.

The colors will be tweaked as well. I'm just sloshing colors around at the moment.

Thanks for the comments.

dont take the "hate" to heart, most people cant see thru the WIP to a finished product. ;)  i think it looks great. i like that the smaller pics are larger than last year(this year?:D ), they can actually get looked at this time. b&w pics rawk too.

I kind of like the new layout.

I think the user ID's are a bit much however.  It just seems "odd" to me.  I guess it helps ID cars, but hell, is it too much to learn people's names?

I wish I had something to contribute.  I'll be in for one for certain though...probably 2.

I bet some pre-dusk shots would really make the colors on that car pop.

Yes Car photo rule!  Don't turn the tires into the Camera!  Turn the tire so that the camera is getting a direct shot of the wheel itself.  Big black tires create a big black eye soar.

Another thing I see with Bears first photo.  Try not to take pictures of the dark side of the car.  You can play with light and highlight parts of the car like Karl did with his first shot.  His picture the front end and all the details "pop" out at you.

Bear your second and fourth shots are great.  the third would be great if the tire was turned so the camera catches the wheel at the same angle it does on the second shot.

Watch the shadows like you have in pictures 5 and 9.

1/2 hour before and a short time after sunset nets "Beautiful" light.  Makes the details of the car stand out (really shows py cars too :( ) as Chuck mentioned about Karl's car.

Yes, I discovered that at Cat Jam - my first opportunity to take lots of pictures of this car when it was clean.

Thing is, I need several things to occur simultaneously:
clean car
clear, sunny evening
free time
good background

Yeah, I got a new windshield for it. The shop could not find an OEM Carlite windshield anywhere so we ended up ordering a PPG w/s. It's 100% identical to OEM save for the logo. What can you do...time goes on, you have to use what's available. I'm happy with it though...no rock chips, no scratches, perfect visibility, what's not to love. ;)

Just an update, most of the monthly spots are filled. Buuuut, I need many more pics for the cover page. Which will be similar to last years setup. The resolution criteria for those pics are much lower, almost non-existent, therefore you can just post them here or email if you prefer.

Thanks.

John Russell's old 86 TC

A REALLY rusty and wrecked TC-converted-to-a-5.0 that we flipped with that Bronco to get the rear end out of easier... :hick:

Looks like you need close to a 4x3 aspect ratio so my LS picture probably won't work.  Here's two others from the 1988 Motor Trend Auto Show at the Baltimore Convention Center.  You could crop the sides a little to make the ratio fit without cropping anything important to the picture.

I thought about the mosaic thing... then I realized there were more humane ways to commit suicide. Actually if I can find a software program that can do it I might just do it for the 09 Calendar.

it's not just ford.  chevy rescinded the licensing on the bowtie badges.  you used to be able to get it almost anywhere, but now the only people who have it are the ones that bought it in bulk before the decision was made.

Its stupid, ford should use the better discression here and let it slide. Matter a fact I’m pretty sure if you call ford though I don’t know who to call maybe someone in customer relations or something I’m sure they would let it slide due to the fact that in deed this is good for business and in every way could only help them and not heart them its free advertisp00get.

Anybody in the autoline or work for ford or knows someone that can reach out for permission. It might be to-late for this one or carepress don’t want to bothered right now but for next year it might help and we could show them the last 2 years of calendars in how professional they are.

Well it's not Ford's decision at this point, it's cafepress' policy. We shall see what they say. They flagged all my images, including the cover page which doesn't have a logo on it (and all the ones from last year as well), and I can't do anything until they release them.

Antonio, if you need a contact at OGC let me know, however I suspect it is as you said, a cafepress generic policy to CYA, a phone call or email from a ogc representative may not even be enough, is there an alternative that anyone is aware of? iphoto calendars linked to a paypal account or something similar? We all would hope that all of your hard work would not be in vain!

Dear Antonio,

Thank you for your response. Unfortunately, even if you were to remove the Ford/Mercury logos that would not make the images acceptable. Please be aware that Ford's trademarks include trade dress rights on the shape of their vehicles.

Try these guys instead. Cafepress obviously isn't looking for our business.

Ange and I use these guys for our business and marketing cards, and the product is very nice. Just make sure you use Internet Explorer (yeah, sorry about that) when you're fitting the images for margins. I typed in .com to see if there was a US page, but it sent me to .ca anyway. Again, very professional product at good prices.

*edit*
I just checked out the pricing on 25 colour calendars, and it came out to $21 before shipping. Is that better than cafepress?

That's nice, but we aren't using shapes, generic line art or even silhouettes.  We are using our own cars.

So I guess we can't have a calendar of clothed people because the clothes they are wearing bear Nike, Levi, Old Navy, symbols and those companies have rights to the shape of their clothing and symbols on them.  I wonder how CafePress would respond to a 12-month calendar of our friends wearing no clothes to avoid trademark infringement.

My order hasn't been cancelled yet.

Antonio,  Do you have a Paypal account?

A simple solution may be to order the calendars yourself and sell them direct and not put them for sale in the Cafepress Store.  I've never had a problem when I've uploaded pictures for items I myself was purchasing.  A downside would be shipping costs.  My latest was t-shirts with underhood pics of my stang.  This one in particular:

As you can see, there are a few logos on it..... No issues with Cafepress however.

And Jeremy, that was the funniest thing I've read in months!!!

I need to get to the root of the problem by contacting Ford and getting permission... whatever that is. Or at least finding out what is needed to get "permission". lol... that just sounds so wrong. I wonder if magazines have to get permission from Ford to put "Mustangs" in their magazines.

I suppose the Auto Industry is hurting so bad we aren't buying cars anymore. We're just buying a "license".

Well you can't order any because they took it down. Anyhoos, if you want to put the pressure on anyone please direct it at Ford. I can even give you a contact though, courtesy of cafepress.

That's the funny part, Ford can't give you permission because there is none to give. Trade dress rights protect from having physical-likeness knockoffs made, not from selling photos displaying their product.

My calanders showed up today!  I had ordered them on 12/31 with overnight shipping, in the hope they would get out prior to sales being closed down.  I would think any ordered prior to mine should ship.  The status was listed as "in production" yesterday at 2:30 PM.  I had given up on them, so I was pretty surprised when the package showed up.  I ordered 5, 4 are for gifts.  They do look good.  Antonio did a great job.  Hopefully there will be an alternative provider to get them into peoples hands.

dude, back off. antonio is puttin these together because he wants to, to promote these cars, in his spare time. the calendars are NOT HIS LIFE. not everyone lives on this board, to respond to your post immediately. if you notice, antonio made zero posts to this thread between the first and third posting of your idea. in fact, if you look at his post history he made NO POSTS at all to the entire board. :flame:
not everybody has the time to go to office max, print the calendars, keep everything organized, take orders, keep everything organized, take money, keep everything organized, and worry about shippin them all out themselves. posting the same comment three times is flat out ridiculous. be patient. when they are available, in whatever form, im sure he will let everyone know.

im not tryin to dirty this thread, and im not upset so i dont need to "chill." i think the calendar is important. it builds pride for those who buy one, and it gets the cars out there to be seen by others who may have forgotten about them, or never see any of them in decent condition. as such it is a BONUS for the community, but not sumthin anyone should get pissy about deadlines over.
if you are gonna help with production and distribution, great! you could have easily offered that help, or sent a PM, rather than rudely reposting what you had already posted, seemingly demandin action.

I got mine today. Suck it, biatches. :flip:

Antonio, great job man. That's awesome. Although for some reason I can't take December 2007 down from the wall... ;)

I would suggest for the reprint that you first take a trip to Staples or Office Max and see a sample calendar for yourself. They might just have thin paper, which a lot of places do (ahem...Kinko's...) to save money. IMO the quality of the Cafepress calendar paper will be difficult to find for that price. But hopefully you can find a good compromise. Unfortunately I don't have any more connections in the print world or else I'd volunteer.

FWIW, the Apple-made calendars (and similar iPhoto albums) are of incredible quality. I've seen them in real life...the printing and paper are awesome. We'd lose the size of this year's calendar, as you mentioned...if you need help with the graphic re-design let me know. That I can definitely help with.

This may sound absurd, but what are the possibilties of something such as a coffee table book in the future with 50....60....100 different cars?  Perhaps a little blurb on each to compliment 2 or 3 pictures of each car?

The link that Antonio provided to Apples iphoto page has an option of a hardcover "coffee table" book. A few friends of mine have ordered these books and they are amazing. I believe they are around $30-40 each, depending on the amount of pages you want. Here is the link again:

I was actually tossing that very idea around in my head with the Apple Books Greg is talking about below. Are there any anniversaries coming up? Guess I could make one just because. But building something of that magnitude will take some time.

I looked into the links Raven sent and the Office Max calendars AM was talking about. Both of them only have 11x17 calendars open. The cafepress calendars are 11x17 closed and 22x17 open. Both of those options will require redoing the layouts. Something I would like to avoid, but that might not be possible.

I'm getting ready to email Ford's lawyer right at this moment. Now that I have some time to think clearly. But it's not looking good (as far as cafepress goes), a friend designed some logos and other things for a local Ford Car Club (which she is a part of), the club was started by employees of Ford and supposedly owned by Ford as well. Cafepress pulled their work too...

No they are not ready, we are just tossing around ideas at the moment. AM: PM me the details of the local place. Meanwhile Karl is helping me get info on how we can get a "license" to sell anything with Ford products on them. Regardless of who we use, it will still be illegal to do so without permission from Ford.

How is that?

A little snippet from the lawyer...

Quote
Ford's trademarks and trade dress serve several important purposes.  First, seeing the distinctive Ford logo on a product or business is an immediate indication that the product or business is authorized by Ford.  Second, a product bearing a Ford trademark is an indication that the product is of high quality and has passed Ford's strict quality control procedures and inspections.  Third, placing a Ford trademark on a product indicates that Ford, or an authorized agent, is the source of the product, and that the product is genuine and not counterfeit.  When the public purchases a product or service sold under a Ford trademark, the public has every right to expect that the product or service is the "real thing."  All of this, in turn, contributes to the value of Ford trademarks as legitimate and important business assets of the company.

At times Ford enthusiasts question why Ford is so adamant about policing its trademarks and preventing unauthorized uses or infringements of them.  It is quite common for someone who is using a trademark without permission to say, "I'm giving Ford free advertising, so why does Ford care?"  Ford cares because it is important that Ford be able to exercise control over the quality of the product or service bearing Ford's trademarks.  If a disreputable business sells an inferior product or service that uses a Ford trademark, the poor quality of that product or service reflects on Ford.  A person who is disappointed by that poor product or service will not take the time to determine whether Ford in fact authorized the use of its trademarks.
They will, probably rightly, assume Ford to be the ultimate source of their disappointment and may transfer their loyalty to a competitor.

If a business not affiliated with Ford uses any Ford trademark, whether through the use of photographs, depictions or silhouettes, or any confusingly similar variation thereof, without Ford's express, written consent, then that business is violating Federal and state trademarks laws.
That business is also misleading the public into believing that such business is affiliated with Ford.  It is also not sufficient for a business to state that it is not affiliated with Ford but continue to use Ford trademarks without permission.  The business is still misappropriating the goodwill and reputation developed by Ford, and attempting to capitalize on or profit from Ford's goodwill and reputation.  Even with the best of intentions, unauthorized use of another company's trademark is against the law and misleading to the general public.

Unauthorized and infringing uses of Ford's trademarks come in many disguises.  Examples of cases in which Ford has successfully pursued infringers include the following:  (1) businesses that use Ford trademarks in their business name such as "John Doe's Ford Repair;" (2) businesses that use Ford trademarks or trade dress in advertisp00gets, including phone book advertisp00gets; (3) businesses that place Ford trademarks or trade dress on products such as shirts, coffee mugs, key fobs, etc.; and (4) businesses that use Ford trademarks in their Internet domain names.

Ford genuinely hopes the public understands the need for Ford to police and enforce the proper use of its trademarks and trade dress.  To protect the value of its trademarks, Ford is obligated to object to and pursue unauthorized uses of its trademarks and trade dress, even if the use of the trademark or trade dress does not appear offensive or objectionable.  If Ford does not do so, it may be deemed under the trademark laws to have abandoned its trademark rights.

The issue with the latest version of the calendars isn't about the logos.

Say I had a stock mint condition turbo coupe and I was really good at professional photography.  I took some stellar pictures of my car, had some posters made giving it a "stock photo" feel, and offered them for sale to the forum members by putting them in an online "store."  Even though it's my car and I took the picture, Cafepress is saying I cannot offer these images to the "public" for sale on products like calendars, posters, T-shirts, mugs, etc.

Quote from: Trademark Paralegal with Howard Phillips & Andersen
Although you may own the Ford automobile, you do not own the rights to the trade dress. Taking pictures of any Ford automobiles, placing them on products (i.e. calendar, mugs, t-shirts, etc.) and making them available to the public for sale is an infringement of Ford's intellectual property rights.

They view Ether's online "store" at Cafepress as a "business" or competition to licensed businesses because the calendars are available to anyone to purchase.  "Taking pictures of any Ford automobiles, placing them on products (i.e. calendar, mugs, t-shirts, etc.) and making them available to the public for sale..."

There are businesses out there who have gone through the expense to obtain proper licensing from Ford to use these trademarks so if we offer similar products, we are essentially competition but without the licensing to do so.  Those who have gone through the steps then have a grievance.

Now with our particular situation, we may be able to get permission because we aren't using logos, the Ford name, or selling large quantities.

Sure.

This whole thing is a real kick in the seeds.  Ether has spent a LOT of time for a stunning calendar (mine came in today - ha, ha).
And those who submitted pictures probably spent some time getting quality photos of their cars.
Just to throw another example out there for everyone, the Coca-Cola bottle is an example I found on a Google search of this whole thing.  Say for instance I took a really cool picture of a Coca-Cola bottle I bought at the store.  Then I used the image for some sort of poster or mug to sell to the public.  Due to the successes of Coca-Cola, that image is instantly recognizable and coupled with a professional photograph, I can sell hundreds of these "personalized" products to "the public."  Since these companies developed the designs, they are protected by trade dress laws.  Understandably so, these companies have a vested interest in how their designs are portrayed and don't want any Tom, Dick, or Harry using their designs in any manner they want made available to the public for purchase.  I guess that's where the permission and/or license process comes into play.
I think our problem is "selling to the public."  We are going to email a trademark license contact within Ford to see if there is any hope or see if they can offer suggestions to avoid "selling to the public" and only selling to ourselves.

I get the pen 15e bottle reference but I still think it's stupid. How many photos are being sold that have copyrighted or trademarked products in them? Do movie producers have to get permission for every single Ford car that happens to show up in the background somewhere? What about magazines?

I would think a simple disclaimer would be more suitable in a situation like this...

These guys are going through a similar problem with Ford/Cafepress.

I'm pretty sure the movie industry has agreements with Ford, pen 15e, Pepsi, Nike, etc. etc.  They are too big to ignore these types of laws.
As for the photos being sold, again I'm sure the legal ones have gone through these steps.  The other ones are in violation and I guess Ford has the right to pull the reigns in on this activity.

Ford sent a multi-page form today for us to fill out.  7-10 days for results.  We'll see what happens...

If it were being offered for sale to the general public on the open Internet, then it would be a trade dress violation.  If these calendars were being offered for sale to the general public at something like Ford Carlisle, then that would also be a trade dress violation.

They have approved it for "internal club use" only, or in our case for forum members only.  That's why I moved the pre-order thread I created to the marketplace section and asked Thunder Chicken to move this thread that Ether947 created to the marketplace - it's only viewable if you are logged in.

It seems as if us and the BMC arrived at two different agreements.

Quote
As posted by Lisa from BMC:

BMC Calendars: Approved by Ford & For Sale!
*** THANK YOU FORD ***

Get rid of those CENSOR graphics ... the calendar issue (and rights to print images of our own vehicles) has been resolved. After hearing from a few members of the Ford marketing and communications team, I have Ford approval to proceed with printing our 2008 calendar as-is as well as use Danni (and our other vehicles) in BMC logos and all the club marketing materials we have been thus far.

The 2008 BMC Calendar featuring the Members of the Month from 2007 is now on sale! I will not be using Cafepress for printing our calendar or any other materials as (1) they have not yet released our calendar for printing as (2) they are not compliant with Ford, and I do not want to support them for that reason. If you wish to order the now-famous calendar, please ORDER HERE through our own online store, and the calendars will ship in approximately 10 days.

Also, just as you emailed Ford, posted on your local forums and spread the word about this issue when it first arose, PLEASE follow-up with a 'thank you' email to Ford, and PLEASE post a link to this new thread on ALL the forums who have been discussing this issue. I appreciate Ford, and want to be sure we get the positive word out now that this is resolved.

Special thank you to Whitney, who has joined our forums and sent the following message:
-------------------------------------

My name is Whitney Drake and I work in Ford Communications.
We've been watching this discussion with interest and I'd like to
clarify what is essentially a misunderstanding.

Yesterday we spoke to both Cafe Press and the Black Mustang Club
and explained the situation (about the Black Mustang Club’s calendar) to everyone's satisfaction. Ford has no problem with Mustang or other car owners taking pictures of their vehicles for use in club materials like calendars. What we do have an issue with are individuals using Ford’s logo and other trademarks for products they intend to sell. Understandably, we have to take the protection of our brands and licensing very seriously.

Ford did not send the Black Mustang Club a “cease and desist” letter telling them that they could not use images of their own cars in their calendar. The decision not to allow the calendars to be printed was made by Cafe Press, because we had gotten in touch with them in the past about trademark infringements on products they sold.

The Black Mustang Club, and any other Ford enthusiast club, are free to take pictures of their own vehicles for use in calendars or other materials as long as they don't use Ford trademarks in products that will be sold.

I think it is great that the Black Mustang Club, and any other enthusiast club, would take pictures of their own vehicles for use in calendars or other materials.

I'm looking forward to purchasing a copy to hang in the garage next
to my Mustang (even if mine isn't black).

Thanks for giving us the chance to have our say.
-------------------------------------------

Please take a moment to send Whitney an e-gift here through the forums to thank her for working with us to get this resolved, and for wanting the calendar, too! She's been a great help and I'll continue to work with Whitney and the Ford team, so welcome her to the BMC family!

If you have any questions, please don't hesitate to contact me directly. I'm enjoyed hearing from all of you who have written with words of encouragement and support. Thank you very much for greatly extending the BMC family this week!

If "sold" only references 'for profit', then it makes sense.

However, BMC is offering their calendar sale to non-members and has the item for sale on a 'public' portion of their website, unlike us.

Although you may own the Ford automobile, you do not own the rights to the trade dress. Taking pictures of any Ford automobiles, placing them on products (i.e. calendar, mugs, t-shirts, etc.) and making them available to the public for sale is an infringement of Ford's intellectual property rights.

The law firm Howard Phillips & Andersen represents FoMoCo.  If that isn't enough, then this is directly from Ford:

that's really awesome I like how the pictures are set up on each page, instead of just a big image you get info and a few detail shots with one nice big one.

Methinks Ford's lawyers were wrong.

Photo Attorney -  Does Ford Own the Copyright in Your Photos?
(http://" http://www.photoattorney.com/2008/01/does-ford-own-copyright-in-your-photos.html ")

I think it is clear that our calendar does not cause confusion as to the source of the product or dilutes the trademark by blurring or tarnishment, and thus is in the legal clear.

Proposed Changes in Trademark Law of Concern to Photographers

The point is moot since Ford could proceed with litigation and bury anyone who tries to disagree, but still...the view from the moral high ground is amazing.

How is this different than our results?
BMC is allowed to sell their calendars to anybody.

We however, can only sell to forum members and have to "batch order and have them sent to one person who then has to turn around and get them to you"

I assume this is because our calendars have actual Ford logos on them, and the BMC does not. The lack of standalone logos makes the BMC calendar free of Intellectual Property problems, whereas we need Ford's permission to keep the logos in.
I ordered one before the CafePress clampdown - the news ones do have logos in them, correct?

Ford has no problem with Mustang or other car owners taking pictures of their vehicles for use in club materials like calendars, including the logos as they appear in the pictures of the vehicles.

I removed the logos from all the layouts, except for Gunkel's. His is in the background of the photo and there's not much (other than changing the photo out -- I didn't want to it is awesome) I could do about that. I will revisit the distribution issue with cafepress/Ford for the 09 Cal.

Nothing wrong with recognizing a poor decision (especially when the almighty Mustang is involved - yes i know i own one) and correcting it.

You can guaran****ingtee we did everything we could to make it easy but Cafepress and Ford made it difficult.  Here I am days before leaving for halfway around the ****ing world for a length of time wrapping and preparing 30+ calendars individually when I had plenty of other shiznit that needed to be done.  Ether spent tons of time putting it together and I spent tons of time and money getting them to me, searching and buying the envelopes, cutting cardboard, writing all the addresses, sending all sorts of PMs, and mailing most of them out before I left even though the payments were slow to come in.
I had a private account set up in Cafepress and they even locked that down so I couldn't order more.  The fact is, this raised a big stink and what's done for this year is done.  We have several months to see what (if anything) Cafepress and Ford will do for us making the distribution more reasonable.

This is ridiculous.  I still haven't received payment from everyone and I still have calendars I bought for people who asked for them but never gave me their addresses.

If you haven't paid, please pay me.  I shelled out a lot of money up front for this.

I'm not doing this next year.

Hi.  I'm Amy, owner of the '87 Turbo Coupe that was in the big photoshoot with a dark gray metallic one at Cat Jam 2007's car cruise-in at Southern Park Mall.  I meant to buy a calendar but just procrastinated.  (Sorry, Antonio, I just didn't follow up on your email!)

I missed CJ 2008 b/c I didn't check the site and didn't notice it had been moved up until after it happened, lol!  I hope everone had a great time.  I've already made a mental note so I don't miss 2009.  I actually have inspection, tags, and insurance now so that I'll be totally legal this year, hehe.

'98 Taurus V8 SHO
'96 P74 fully loaded Crown Vic
one rusty '93 Chebby Silverado RCLB 4x4 just for fun
maybe a 3/4 ton diesel longbed later in 2009, or maybe not  ;-)
